Legal Services

We have a staff of experienced attorneys, accredited immigration advocates, and volunteers who provide free legal services to people living with HIV/AIDS. We assist clients with immigration matters, eviction prevention, family law issues, permanency planning, employment discrimination, debt collection, bankruptcy, public benefits, wills, living wills, health care proxies, and confidentiality complaints. We provide direct legal advocacy, representation, pro se advice, and appropriate referrals. We do not provide assistance or advice in criminal cases.

Legal Services Walk-in Clinic If you are a registered GMHC client and would like to speak to a member of the legal staff about a legal matter, you may call 212.367.1134 or come to the 6th floor on Tuesdays & Thursdays, 2 pm to 5 pm (YOU MUST BRING PROOF OF HIV STATUS, ADDRESS, AND INCOME). However, if your case involves an immigration issue, you must first make an appointment by emailing legal@gmhc.org or calling 212.367.1134. 

Discrimination

We assist clients who have been discriminated against in employment or public accommodations.  We also assist clients with reasonable accommodations issues. For more information, please contact legal@gmhc.org or call 212.367.1134.

Confidentiality

We advise and represent clients on confidentiality matters. For more information, please contact legal@gmhc.org.

Employment

We advise and represent clients who are unable to continue working due to their HIV illness or may need a reasonable accommodation under the Americans with Disabilities Act.

We assist clients interested in applying for disability benefits.

We advise clients whose health conditions have improved and are considering returning to work, or accessing work for the first time. For more information, please contact legal@gmhc.org.

Insurance

We advise clients regarding health, life, and disability benefits. For more information, please contact legal@gmhc.org.

Bankruptcy & Debt Management

We assist in filing Chapter 7 (or no asset) bankruptcy petitions for clients.

We advise clients who are being harassed or sued by creditors.

Estate planning

We assist clients in need of wills, health care proxies, living wills, medical directives, powers of attorney, and affidavits of cremation. For more information, please contact legal@gmhc.org or call 212.367.1134.

Landlord/Tenant

We assist clients facing eviction due to non-payment or holdover petitions.

We assist clients who claim the right to succeed to the apartment of their partner or other family member. For more information, please contact legal@gmhc.org or call 212.367.1134.

Immigrant Legal Services

We assist clients to obtain "green cards," work authorizations, asylum, citizenship, and benefits. Immigration matters are handled by appointment only. To make an appointment, please contact legal@gmhc.org or call 212.367.1134.

DACA Legal Services

Do I qualify for DACA or deferred action?

It’s possible that you qualify for DACA or deferred action for childhood arrivals, if:

  • You came to the United States before the age of 16
  • You have lived continuously in the U.S. since June 2007
  • You are at least 15 years old
  • You are a high school graduate or are currently enrolled in high school or have a GED or are enrolled in a GED program
  • Obtain updated information to process check request for payment of housing costs to maintain stable housing and avoid homelessness from landlord or HASA;
  • You are an honorably discharged veteran of the Coast Guard or the armed forces
  • You have not been convicted of a felony, serious misdemeanor or three misdemeanors
