GMHC strongly believes in protecting the privacy and integrity of personally identifiable information gathered from visitors to our web site located at http://www.gmhc.org (the “Site”).  

Since the protection of your privacy is of the greatest importance to us, we have created this privacy policy (“Privacy Policy”) to communicate how we protect the personal information that you supply voluntarily and will describe the choices you have concerning such information.  Please read this Privacy Policy carefully. 

We may need to change this Privacy Policy from time to time in order to address new issues and reflect changes on the Site.  We will post changes here so that you know what information we gather, how we might use that information, and whether we will disclose that information to anyone.

Changes and modifications to this Privacy Policy will be effective immediately upon our posting of the changes and modification on the Site, except where prohibited by law.  You agree to review this Privacy Policy each time you use the Site.  By submitting your personal data to us, you consent to the collection and use of your personal data in accordance with this Privacy Policy.

The Site is a general audience web site and GMHC does not knowingly collect personally identifiable information from children under 13 years of age.

What Information We Collect: You do not need to share personally identifiable information to use the Site. Personally identifiable information is information that can be linked to a specific individual, such as a name, address, phone number or email address. You can visit most portions of the Site without telling us who you are and without revealing any personally identifiable information.

GMHC uses Internet Protocol (IP) addresses to analyze trends, administer the Site, track visitor movement and click-through behavior and gather broad demographic information that is not personally identifiable. This information helps us to better understand our visitor’s site usage patterns and the types of content and information that may help improve your experience on the Site.

We gather personally identifiable information when you when you sign up to receive our monthly newsletter or when you fill out GMHC’s “Get Help” or “Contact” forms. GMHC does not collect personally identifiable information about people without their permission.

Cookies:
GMHC uses “cookies” on GMHC Donate pages, when a visitor signs up to receive additional information on our fundraising platform, Classy. A cookie is a small piece of data stored on a visitor’s hard drive that does not itself contain any personally identifiable information. Cookies enhance a visitor’s experience by saving the visitor from having to log in or provide information each time he or she re-visits GMHC pages which are accessible by registered users only, and by customizing content based on a visitor’s indicated interests.  You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether to accept it. You may continue browsing our Site even if you decide not to accept the cookie. However, if you decide to erase or block the cookie you may not be able to utilize some features of the Site.

Web Beacons:
GMHC employs a software technology that serves as a web tracking device to collect certain information about traffic to the Site. This device is classified as a “web beacon” by the Network Advertising Initiative, which means that the scope of its collection is restricted to Site traffic data. It is similar in function to cookies. The main difference between cookies and web beacons is that web beacons are invisible on the page and are much smaller, about the size of the period at the end of this sentence. A P3P-compliant JavaScript cookie is set and collected by the tracking device to allow for differentiation between visitors to the sites. This data is used for tracking and reporting aggregate usage patterns on the Site but does not include any personally identifiable information about individual visitors.

How We Use Personally Identifiable Information:
We use your personally identifiable information to send you legislative updates, action alerts, press releases, information about GMHC programs, events and activities, local volunteer opportunities and information about appeals to various government agencies.

Credit card donations:
Site donations are processed exclusively by Classy. Classy is committed to providing safe, secure and private online transactions. For further details about their privacy practices and security precautions, please consult the Classy privacy policy directly from the link on our donation page.

When you make a donation to us through the “Donate” button on our Site, Classy shares your personally identifiable information with GMHC so we or Classy may acknowledge receipt of your donation for tax purposes and, unless you ask us not to, include you on GMHC’s mailing list. If you do not wish to be added to our mailing list, our online donation form has an “opt-in” mechanism which can be unchecked for those users who wish to make donations, but do not want to receive any additional email correspondence from GMHC. You may also make donations anonymously by checking this preference on the donation page.

When you send a donation in honor or in memory of someone and request that an acknowledgment be sent to another individual/family, we will use the name and address of that individual/family for acknowledgment purposes only.

Email You Send to GMHC:
If you choose to correspond with GMHC through email, we may retain the content of your email messages together with your email address and our responses. We provide the same protections for these electronic communications that we employ in the maintenance of information received by mail and telephone. Any email we receive is read only by those individuals who are essential to answering the question(s) presented.

Disclosure To Third Parties:
We will only share your personally identifiable information with Classy (as described above), or with another third party, provided you give us your express permission, or if we are required by law to do so.

Email Newsletters and Other Email from GMHC:
You will only receive email newsletters from us if you have expressly signed up for a newsletter on the Site or at a GMHC event.

The information we gather from subscribers to our email newsletters (including email addresses) is not shared with other organizations or parties. From time to time we may send out email on behalf of other organizations, but we do not provide them with access to any personal information that you have provided.

All sent email contains a link to unsubscribe or to modify your profile. You may subscribe or unsubscribe to any newsletter or other email communication from GMHC at any time.

How We Protect Your Information:
GMHC cares about the safety and security of information gathered through its Site. Our Site has security measures in place to protect against the loss, misuse or alteration of the information under our control. Our web server is located in a locked, secure environment. All databases containing personal information are securely stored on a separate system that is not connected to the Internet.

Other Web Sites:
Please be aware that our site contains links to other web sites. GMHC cannot control and is not responsible for the content or the privacy policies of those web sites.  This Privacy Policy does not apply to any web pages not under a domain owned and operated by GMHC, regardless of any hyperlinks from a web page under our domains to external web pages. We advise you to check their privacy policies as well.

How to Unsubscribe from Mailing Lists:
All GMHC communication, whether via email or U.S. mail, provides information on how to unsubscribe quickly and easily. Those wishing to not receive communications from GMHC (“do not contact”) can simply notify our member services at webmaster@GMHC.org.

How to Correct Information You Have Provided:
You may correct and/or change any information regarding your request to receive additional information from GMHC, participating in campaigns and action alerts, or online donations by contacting us at webmaster@GMHC.org.

Miscellaneous:
This Privacy Policy shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to conflicts of law principles of such state.  You agree to submit to the exclusive jurisdiction of any State or Federal court located in New York, New York, United States of America, and waive any jurisdictional, venue or inconvenient forum objections to such courts.  If any provision of this Privacy Policy is found to be unlawful, void or unenforceable, then such provision shall be deemed severable from this Privacy Policy and the remainder of the provisions this Privacy Policy shall remain in full force and effect and shall in no way be affected, impaired or invalidated.  This Privacy Policy is the entire agreement between you and GMHC relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements between you and GMHC with respect to such subject matter. This Privacy Policy may not be assigned by you without GMHC’s prior written consent.  The failure of GMHC to exercise or enforce any right or provision of this Privacy Policy shall not constitute a waiver of such right or provision.  The rights and remedies herein provided shall be cumulative and not exclusive of any rights or remedies provided by applicable law.  Any heading, caption or section title contained in this Privacy Policy is inserted only as a matter of convenience and in no way defines or explains any section or provision hereof.
